Consequently, it has been left to lawyers and judges to shape the meaning of “discrimination,” with differing perspectives vying for ratification. For instance, as detailed in chapter 5, many contend that the definition of discrimination that has prevailed in sex discrimination decisions has been dictated by the male-dominated judicial system (MacKinnon 1979; Nelson and Bridges 1999; Baer 1999). Nelson and Bridges (1999) note that the concept of comparable worth failed as a result of the judicial system accepting the unsubstantiated evidence that the market, rather than discrimination, determines pay differences between men and women.
