Each subsystem (politics, law, media, economics, science, art, etc),11 will identify the communications that belong to it. Each subsystem will communicate about itself, and what it describes as something other than itself: its environment. Only now, with the repetition of autopoiesis at the subsystem level, the environment that can be described is not only the physical world but also other subsystems of communication, as well as any communications that do not belong to any particular subsystem (general social communication).
Why was ‘A’ legal, and ‘B’ illegal? A communication explaining an earlier coding is also a communication available for the making of a future coding. This process produces, inevitably, distinctions. Distinctions, in turn, can be generalised into categories, building to the exercise well known to lawyers, the generation of doctrines. And, just as one can have, at the level of society, communications about both society and nature, one can have the equivalent within subsystems. 22 ‘As soon as writing was available, the system’s memory lost its ease of forgetting, of not returning to an issue, or of remoulding a suitable past.
8 The closure of the social system of communication is an operative closure. First, because the closure is repeated each time that a communication occurs: each time a new communication is made (something is recognised as a communication), and secondly, because the closure is a product of operations. The structures of communication that restrict and facilitate what it means to communicate (and what each communication means) are themselves communications. This also explains the nature of the evolution of communications.
